Lawsuit filed against Masrour Barzani and 5 other officials 28.12.2006

Vienna, Austria, December 28, ( ,-- According to the article published on Dr. Kamal Said Qadir, a Kurdish international legal expert, writer, human rights and anti-corruption activist who last year was abducted and subjected to kangaroo justice in Iraqi Kurdistan, writes to say he has filed charges for kidnapping and torture with the public prosecutor in Vienna, Austria, against Masrour Barzani, the son of Iraqi Kurdistan region President Massoud Barzani.

Masrour, a 1997 graduate of American university runs Iraqi Kurdistan's intelligence and internal security service. It will be interesting to see whether Europe now places real politic above its rhetoric of justice and human rights.

Dr. Kamal confirmed to portal today, that the lawsuit has been filed on Dec.19, 2006 against five high ranking officials of KDP Kurdistan Democratic Part and Parastin (Kurdistan Security police):

1- Masrour Barzani,
2- Delshad Barzani
3- Kameran Mufti (deputy of Masrour Barzani)
4- Nawzad Hadi Mawlud ( the governor of Erbil)
5- Dr. Pirot Ahmed

The lawsuit is based on both, international law and Austrian national laws.

"Now I hope that the Austrian judiciary prove its independence and neutrality, regardless of the position and wealth of all persons involved in this case. I have filed the lawsuit by myself, what was not so difficult for me as a legal scientist" Dr. Kamal told

He added "I appeal on Kurds in Kurdistan- and outside to show civil courage and resort to courts to protect their rights, regardless of the position of the perpetrators. Establishing the rule of law and strengthening the democracy in Kurdistan requires civil courage and sacrifices from us all."

"I am ready, as a lawyer to assist any Kurd, the basic rights of whom have been violated by whomever, to make use of the very effective judiciary in Europe and USA. We are certainly aiming at establishing a real democracy in Kurdistan and not a semi-dictatorship like those exist in our neighborhood." Kamal said.

He continue "I may also advise the KDP and Parastin to stop sending me threats because I am a free man and fearing nothing and nobody on the earth, while respecting the rights of others."

on December 19, 2005 a court in Erbil (Hawler) in Iraqi Kurdistan, had sentenced Dr. Kamal Said Qadir to 30 years in prison for the "crimes," allegedly based on the law of the Kurdistan Regional Government (KRG), of "disgracing the Kurdish leadership and their struggle," "inappropriate articles," and swearing at the Barzani tribe.
